Terms of Service for Dogcare

These Terms of Service explain the terms and conditions that apply to your access and use of the Dogcare application and constitute a legally binding agreement between you and Dogcare. Please read these Terms carefully. By using Dogcare, you acknowledge that you have read, understood, and agree to be bound by this entire Agreement. If you do not agree with this Agreement, do not use the Dogcare service.

We may change these Terms from time to time, so please review them regularly.

1. The Dogcare Service

Dog Care is an application that utilizes artificial intelligence to identify and analyze potential issues related to your dog from image and audio. The service allows users to capture photos and videos of their pet dogs, which are then processed into diagnostics, advice and suggestions. Dog Care does not own the content that users upload or process.

Dog Care complies with applicable laws and fully respects third-party rights. The app is not liable for the content uploaded by users, nor for the results or advice generated by Dog Care from such content.

2. Changes to the Dogcare Service

Dog Care reserves the right to modify, add, or remove features and functionalities of the service without prior notice. We may discontinue some or all features of the service at any time. If you are dissatisfied with any changes to the service, your only option is to stop using it.

3. Privacy Policy

The Dog Care Privacy Policy, available within the application, governs how we collect, use, maintain, and disclose information from users. By using Dog Care, you agree to the terms of our Privacy Policy and acknowledge your understanding of how your personal information is handled.

4. Using the Dogcare Service

Dog Care is for personal, non-commercial use only. You may not resell, sublicense, transfer, or exploit the service commercially. You agree not to use the service in any unlawful manner or attempt unauthorized access to the service. Unauthorized use, such as hacking or collecting data from other users, is strictly prohibited.

When using the service on a mobile device, you are responsible for any charges, data rates, or fees that your wireless carrier may apply.

5. Your Content

By uploading or submitting your image and video files or other content to Dog Care, you grant us a non-exclusive, revocable, royalty-free, fully paid, sublicensable, and transferable license to use, modify, and distribute the resulting results. You must ensure that you have the necessary rights to upload and process the content you submit.

"Your Content" includes any images and video you upload in connection with the Dog Care service.

6. Termination of Service

You may terminate your account and stop using Dog Care at any time by contacting customer support. Dog Care reserves the right to suspend or terminate your account at any time, with or without notice, for any reason. Content you have uploaded may be deleted upon account termination.

7. Intellectual Property and Licenses

Dog Care retains ownership of its software and services. You are granted a non-exclusive license to use the service for personal purposes only. Unauthorized use, data mining, or scraping of the service is strictly prohibited.

If you believe that content available through Dog Care infringes your intellectual property rights, you may report the infringement to us, and we will take appropriate action.

8. Procedure for Reporting Claimed Infringement

If you believe that your intellectual property rights have been infringed upon by any content on Dog Care, you should send a "Notification of Claimed Infringement" to us, including:

• Identification of the infringing material;
• A physical or electronic signature of the copyright owner or authorized agent;
• Contact information, including address, telephone number, or email.

9. Notice for Apple Users

This application is governed by Apple's standard End User License Agreement, which can be found here: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

If you are using Dogcare on an Apple device, please note that this Agreement is between you and Dogcare not Apple. Apple is not responsible for any claims or issues related to the use of the Dogcare app.

By using Dogcare, you agree to comply with applicable third-party terms and conditions, including those set by Apple.

10. Subscriptions Terms for Google Play Users

We are committed to enhancing your experience through our subscription plans. In app subscriptions will be charged via your Google Play account. Here's what you need to know about our offerings:

1. Free Use: Access to all core features, including AI photo identification, for a limited-time free trial. The specific duration of your trial will be displayed within the app during the sign-up process. Once the trial expires, a subscription is required to continue using some features.
2. Subscriptions:
   • Weekly: This is an auto renewing subscription plan that is billed weekly
   • Monthly: This is an auto renewing subscription plan that is billed monthly
   • Annual: This is an auto renewing subscription plan that is billed annually
   • Your subscription will automatically renew unless it is canceled at least 24 hours before the end of the current period.
3. How to Subscribe?:Go to the Home Screen > Pro Icon > Select the subscription plan
4. Cancelling Your Subscription: It is sad to see you go! But we are committed to providing easy procedure for you to follow if you choose to cancel your premium access. Simple Process:
   • Please click on this link to go to Subscriptions screen on Google Play: https://play.google.com/store/account/subscriptions
   • Select the Dogcare App in the list; Select the subscription or plan you want to cancel
   • Tap Cancel Subscription or Manage subscription
   • Follow on screen instructions

11. AI Data Processing and Third-Party Disclosure

To provide our meal analysis and nutritional insight features, Dogcare utilizes advanced artificial intelligence technologies provided by third-party services, primarily OpenAI, LLC.

• What Data is Shared: When you use the photo logging, voice logging, or chat features, the specific content you provide (such as images, audio recordings of your voice, or text descriptions) is transmitted to our third-party AI processors.
• Purpose of Sharing: This data is shared solely to perform the analysis, and provide the conversational AI responses requested by you.
• Third-Party Privacy: We ensure that our third-party AI providers (OpenAI) provide a level of data protection at least equal to our own. You can review OpenAI's privacy commitments at https://openai.com/policies/privacy-policy.
• User Consent: By enabling AI features within the app and submitting content for analysis, you provide your explicit consent for this data to be shared with and processed by these third-party providers. You may opt-out at any time by ceasing to use the AI-driven features of the application.
